Do I have to pay tax on my winnings from online gaming in India?
Yes, as per Indian tax laws, winnings from online games (including Rummy, Poker, etc.) are subject to a flat 30% tax (plus cess) under 'Income from Other Sources', without any deductions for expenses or losses.
How is TDS (Tax Deducted at Source) applied to my winnings?
As of April 1, 2023, TDS is applied on net winnings from online gaming. Winnings over ₹100 in a financial year are subject to 30% TDS at the time of withdrawal or at the end of the financial year. The gaming platform is responsible for deducting this tax.
What if I win a large sum, say ₹5,00,000, how will the tax be handled?
If you win ₹5,00,000 and the net winnings are also ₹5,00,000, then 30% TDS (i.e., ₹1,50,000) will be deducted by the gaming site before the remaining ₹3,50,000 is credited to you. You will receive a TDS certificate (Form 16A).
Do I still need to declare my winnings if TDS has already been deducted?
Yes, even if TDS has been deducted, you must still declare your total winnings and the tax deducted in your Income Tax Return (ITR). The TDS amount will be reflected as tax already paid.
